Who is responsible if our child was personally injured at school?

My daughter contracted poison oak which was readily at her reach in her school yard. There is one unreimbursed medical bill from our insurance company and the school has not responded to my request to take care of it. Can I bring a successful course of action against the school?

You can file a claim and then sue on the denial. No one would ever predict the probability of a successful suit. See your local law librarian for Cal. LPleading and Practice by Matthew - Bender for the process to sue a governmental entity, which includes schools and school districts.

If the school is a public school, request from the school a Tort Claim. There is a prerequisite to filing the Tort Claim before you can sue. If it is a private school, you should write a certified letter and demand reimbursement of the medical bills.

You can sue them in small claims court. However, look at the amount of the bill and your time and her time to file suit.
