How much of the payout should a personal injury attorney get?

I had a car accident and my lawyer wants 33.3% of what the insurance company gives and she says that is how much she is supposed to be getting. Isn't that a liitle bit too much? I thought the limit was 30%.

There is no limit and in fact no law that states the amount an attorney can or cannot get. The attorney's fees are supposed to be negotiated and contracted before you retain the attorney. I would go back to your signed contract and see what the amount was that you agreed to.

Actually, there are no "limits" other than 1) what is in the contract or 2) what would be considered unconscionabe. Vague term. 1/3 is not beyond the norm. I charge lees before trial and take my percentage out of the proceed after expenses. If you have a gripe about the amount, you can always ask the local bar to mediate the fee.
